Court denies injunction in defamation suit against DEP
On April 17, the Indian Express published an article on DEP's managing director wherein he defended the rights of lyricists/composers and underlined the need to improve the administration of copyrights in the Indian film and music industries.
Two wellknown Bombay-based record companies, TIPS and Venus, both of them members of the Governing Council of the Indian Performing Rights Society, gathered the impression that the statements applied to them and filed a defamation suit against DEP and the Indian Express group of newspapers in the Calcutta High Court seeking ad interim injunction, claiming "disparaging and/or defamatory statement" following which "lyricists and producers of films will decide as to whether or not to deal with [TIPS and Venus]." And, hence "loss and damages."
Today, after listening to all parties, the Hon'ble judge declared: "[...] I am of the opinion that the petitioners have not made out a prima facie case of defamation. Therefore, no injunction is required to be passed [...]" (Vide: G.A. No.1681, 1745 & C.S. No.132 of 2005).
